Between the situation of the professional assistants or substitutes
or assistants of the parties on the one part hand, and that of the Official
Pursuers and Defenders on the other part hand there is this
difference. Whether to the purpose of justice desirable or
no, in the nature of the case the professional assistants can
not be debarred from holding communication in private with the parties
whose assistants they respectively are. Not so in the situation
of the correspondent official assistants. In no case
with the exception of those which will particularly be brought
to view can survey be necessary or conducive subservient to the purposes
of justice. Of the Official assistants the quantity of the time allottable
to this purpose will always be a limited quantity: by excluding
the public from the cognizance of what passes on the
occasion of the interview between the parties and then the
respective assistants, no time would be saved: on the contrary
an indefinite quantity of time would be consumed. What is
saved the q of the time thus bestowed on several the
quantity could be more or in a less
degree dependent on favour: whereas when nothing passes over
and when that of which the public is a witness, everything
of favour is thereby . <p>It may be and that or nothing is to pass but
what is a pass in public it will pass at the same time before the Judge
but forasmuch as after the party it gave at the same time
before the Judge, in that this consists the use of giving
employment to those two other functionaries?
