Ch. XX Defenders of the Helpless
§. 1. Field of Service
Art. 5. Rights of the defenders of the Helpless.
Exceptions excepted, in every suit he has a right to interpose
on either side and offer his assistance.
Art. 6. An exception will be, if the case being declared
non-penal, and private between private pa government not a party, the Judge, at the instance of all
parties on both sides, shall think fit to inhibit such his
interposition.
Art. 6. Obligations of the Defender of the Helpless.
In every such On every occasion he is bound to afford his assistance
to every party, on either side or on such and whatsoever side
is he buy or to parties in any number on both sides
in relation to whom, the Judge, of his own motion, or at
the instance of any other person actor in the judicial theatre,
has declared himself satisfied, that such party is not of
himself competent, to make adequate provision for the
support of his own cause, or able to procure adequate
aid from any substitute or assistant, gratuitous or conductitious.
Art. 7. In a cross suit, in which the Public Pursuer
whose side is commonly on the pursuer's side, is placed located on the
Defendant's side, the place of the Defender of the Helpless if he can
affords produces it made of his assistance, has place himself is on the
Pursuer's side.
Art. 8. On whatever side he be, if the one poses to be such that he can find nothing
which consistently with sincerity he can either not find anything to
do or say, in the support of the interest of a party whose
cause he has espoused his Client he will declare as made to that effect without scruple,
of the its sincerity, the declaration will have for Judges the several
other actors in the judicial theatre.
