Immediate Registrars.
§.1. Field of Service.
Of a Registrar of an Immediate Judicatory,
the field of service, as here proposed, includes two
divisions: the Judicial and the Extra-judicial.
By the Judicial branch the field of service of this functionary,
understand that which is performed in the
Judicatory itself.
By the Extra-judicial, understand that
which is not performed in the Judicatory itself nor
has for it's subject matter the business of the Judicatory.
It's relation to the Judicatory and the business
of it is however unquestionable; for it consists in
the erection and preservation of an aggregate mass
of Evidential matter, not a particle of which is
there that is not of a nature to be eventually employed
in the character of Evidence, on the occasion
of a Judicial suit.
Of this mass of Evidentiary matter, the General
character is designated by the denomination
of pre-appointed Evidence: the use of it, and the cause
of it's being brought into existence, being it's aptitude
to serve in that character. For the most part, the
evidence employed on the occasion of a suit does
not receive it's existence till after the commencement
of the suit: but of this class of evidence, it is
the characteristic property to have been brought in
existence at a point of time anterior to the first
moment at which it comes to be employed.
The purpose of it's existence being the being employed
in some future suit or suits which, as yet, are
but in contingency.
