Art. Function in relation to preappointed Evidences
Whether this whole business – the whole of it – should
be manag under the management of the Registrar of
the Judicatory and his Deputes, or whether it had
best be placed in other hands will may be matter of consideration,
in the result of which the quantity of population
in a Judicial Sub-District will naturally
have more or less influence. The relation between
the custody of the mass of evidence and the recordation of the
eventual view of it in the exercise of the functions
to the due exercise of which it is designed to be subservient
affords a reason for placing it in the
same hands and there seems no reason for placing
it in different hands.
Of this one of the several Magisterial Offices belonging to
a Judicatory the business consisting in mere labour
and consumption of time without power or means
of displaying talent and acquiring distinction, it
may perhaps when where the quantity of business is such
as to req occupy the whole or a considerable portion
of a man's time, be nece found necessary to afford
a remuneration to the functionary in a pecuniary shape.
It should be the whole of it at the expence of the public.
If at the expence it would thence fall heaviest on every
man in proportion as his pecuniary circumstances
were narrow.
