In the situation of Judge Appellate it seems no
very determinate matter to determine what provisions to make in regard
to Deputes.

One Depute permanent at least can not be
dispensed with left unprovided: the Justice in a whole
district must not be abandoned to d indefinite delay
to denial for an indefinite time. It is not altogether without
regret that the possibility of the like result from the simultaneous
incapacity of two persons can be contemplated.

But a person at the same time qualified and disposed willing
to take upon himself the task of judicature in its highest resort
stage where and how is to be fined? No person
who has not for a considerable length of time served officiated in
an Immediate Judicatory would not neither be thought nor
would really be sufficiently qualified. But upon the
same tour of labour with distinction, power and appropriate
reputation proportioned to good desire indeed but
without anything in a pecuniary shape, can there
be any well grounded prospect of attracting men from
an Immediate the Immediate Judicatories from either the situation of Judge
Principal or the situation of Judge Depute permanent in
an Immediate Judicatory? For barren however In the one case, he would
have to quit a pecuniary provision in possession; in
the other the same in expectancy.

Of this difficulty the nature of the case seems scarcely
to afford any other solution than that to providing a Depute
p
for a Depute permanent a salary mass of pay not considerably
different from inferior to that of the principal.
