aptitude

1. Partly the same, partly
different the securities
here, as compared
with do. in the case
of officials.

2. I. Precedential.
These coincide nearly
with those that apply
to Government
and Eleemosynary advocates.

3. II. Securities concomitant,
at large.
Of these, publicity is
the main instrument
and of this, the application
is here maximized:
the quantity of
the Lawyer's dealings
with his Clients and
their adversaries brought
under the eye of the judge
and the public being
here maximized.

4. By this extra publicity,
particular security
is afforded agst
wrong to clients.

5. Less against wrong
to client's adversaries.
For, whoever is conscious
of being in the
wrong, prefers for law
coadjutor the man
who is most willing
as well as able, to
do wrong to the adversary.

6. An instrument of
security which applies
peculiarly to the Professional
Lawyer, direct
and constant subjection
to the power
of the judge, subjection
less reserved than in the
case of the Government
and Eleemosynary Advocates:
they being raised
above him by that official
character.

7. One species of wrong
against which the party
who is in the wrong,
especially when sincere,
(tho right being dubious)
requires to be, and is
here specially prohibited
by the increased control
given to the judge and the
Public Opinion Tribunal
is that which is done by
a party's swelling his own
costs, in the assurance
of their being laid on the
adversary's shoulders.

In this case, the Lawyer
may have for confederate
in sinister interest
and practice, his client.
Of this, the Legislator
and judge should be aware:
and so arrange matters
that, at the earliest stage,
the costs probably necessary be ascertained
and minimized.
