§. 1. Who

Art. An Advocate or by Argumentator is he who
without conducting the taking any part in the conduct of the
business as such gives himself to the Client his assistance
in no other way than by stating to the Judge the nature
of the case according to the instructions he has received
from the Client or his Attorney commonly the Attorney only
and representing presenting it in such light with relation to his Client as to him appears most
to him most advantageous.

In Bonapartes Code but one sort of lawyer presents
himself to view his official name is
Avoué. But under this name the Attorney before the French
Revolution called Procurent, and the Advocates are it should
seem both comprized.

In England, in place or on an occasion in which
a Barrister is not to be had, his functions are exercised by
an Attorney: but on no occasion are the functions of an
Attorney executed by a Barrister. He would destroy his reputation
among brother Barristers and Attorneys beyond recovery
were he to attempt to save to a Client the expence of employing
an Attorney. For lawyers have their points of honour
as well as thieves.

Advocate is a general and expressive appellation originating in the
Roman Law. In Scotland accordingly the Advocate is termed
an Advocate. Barrister is a term peculiar to England.
In early times rude ages, an individual brought for judgment before
a Judge would sometimes be feel his strength piece of little
inferior to the power of punishment belonging to the Monarch
whose ever removable creature the Judge was: a bar was
regarded as a necessary implement to procure secure the Judge against
sudden violence: the place of the Advocate was behind this bar by the side of the
his Client on whose behalf he was to speak.

To entitle himself to be called act as a Barrister a man must be called to the
Bar: which he can not
be without having proved
himself qualified.
The proof is given by having
call or being supposed to
in a certain room
for the space of five years,
and in the course of it spoken
several times on whatever a few words which are always the same, to those others whose appropriate aptitude has been demonstrated by the same process.
