4. Notaries. Of the sort of functionary stiled an
Notary the occupation consists in the penning of instruments
of contract and conveyances.
By a contract, a one person promises and if in so far as it is valid binds himself to render to
another, absolutely or eventually certain powers wh service in this or that shape
in which but for such promise he would not be bound
to render to him.
It may be either Incident to and The inverse of a contract is a
release. By a release, so far as it extends a contract which before had
been binding is rendered no longer so, the binding force
of a contract is extinguished.
By a conveyance, for a mass of property, in
this or that shape, a new course, certain or eventual as between one hand
and another is marked out: a course different from
that which but for the conveyance would have been taken
by it.
By A contract the term contr is either unilateral
or plurilateral or say mutual: unilateral where it is
on by one side only that any promise is made: mtual,
where one promise at least is made has place on each side. In the
case the promise on each side is commonly the inducement
to is remuneration for the promise made on the other.
A conveyance pr contract may have for its
subject matter, sole or principal – a conveyance, it may
be consist of a promise to make the such conveyance: – this neither more
nor less.
A conveyance, to answer fulfil its purpose will
very commonly require promises of various sorts to accompany
it or be included in it.
