Art. 8. By Law instruments or say Formularies understand Procedure instruments
of Procedure to wit of judicial procedure. Conveyances
and Contracts and articles of written Evidence.

Procedure instruments understand all written discourses
issued or penned on the occasion of a suit at
law thereby commenced continued or ended.

By Conveyances and Contracts understand all such as those
law instruments which whether issued as are issued in contemplation or not in the
occurrence of a suit. By To some of them it may incidentally accidentally happen
to be issued on the occasion of a suit. It is in contemplation
of some eventual suit at law that they are framed: for
the use of them is to furnish evidence on the occasion of a suit at law
in which the rights
which they serve to
shall have come
in contestation.

Close is the resemblance yet not indistinguishably
the nature of a Conveyance and a Contract.

By a conveyance are transmitted to the party receiving
rights a right not only to serving at the hands of
the party conveying, but along with them the right & the service certain correspondent
services at the hands of other persons at large: to wit the
negative service consisting in the abstaining, from exercising the exercise
of all acts of occupation on the subject matter conveyed,
and all acts incompatible with the exclusive enjoyment of
the benefits derivable from the use of it.

Contract By A By a contract is either sought sought or By as such, no right is conveyed other
than the right to certain services therein specified without at
the hands of the contracting party or parties with or without
their respective representatives.

A contract is either single-secured or reciprocal.
A single-secured contract is that by which an one party conveys
to another the right to the service therein specified without receiving
in return a right to any other service at the hands of the
party in whose favour the obliga correspondent obligation is contracted.
