Instructions
The function to sort of business the alliance with which in the person
of a Notary is most natural and least exposed to
the danger of being mischievous is that of Managing
Trustee or Steward, taken in one of the the sources of the word Steward. In the management of a mass of property to any considerable
extent, natural and not unfrequent will be the
occasion for conveyances and contracts instruments of contract and conveyance. A Lease to a Tenant is an
instrument of conveyance: and in every Lease there will
be occasion for divers contracts – for divers
promises on both sides: those on the one side in consideration
of and return for those on the other.
Thus it is By unapt penmanship a the Notary might on divers
occasions make work for the litiscontestational Savages: and
thence it is that the Code will in the penning of instruments of
contracts and conveyances the Code Legislator will by himself do as much
as can be done by himself leaving as little as may be to
those whose interest so long as they can find a plausible
pretext or excuse is – to do it as badly unaptly as possible.
The mischief capable of being done for the sake of
sinister profit would be liable to receive considerable encrease
were he to engage enter into and act in a partnership with
a Managing Steward Trustee. It may therefore be well to interdict
any such partnership: rendering it invalid unbinding and punishable.
Evasion might not be impossible: but could not ever be safe
of the two occupations in the the same hand would
be much less dangerous have in it much less danger: for the sinister interest and
the facilities for promoting it would be obvious to every
eye.
