Of professional lawyers three principal classes are
dis distinguishable under the Napoleon Code, to wit 1. Attorneys Avoués or under English law say Solicitors;
2. Advocates, or say under English bred law Barristers or Counsel.
3. Transactionists or say under Rome-bred law Notaries
under English bred law, Conveyancers Conveyancers.

The Attorney denomination Attorney was in its origin a
significant and characteristic: its significati was what it signified was a person who on the occasion in question acts in
the place or stead of another to wit the party whose interest is
at stake. In this sense it was applicable to not only to
litiscontestational transacti but to non-litiscontestational
transactions: witness as in the case of the instrument called a
power of Attorney.

Of Of The denomination Avouié the particular its origin so late
time of fabrication as as that of the Napoleon Code have
the origin may be
seen at present, in the Napoleon Code: though perhaps the inventor
first introduction of it was under one of the forms preceding Revolutionary
Governments. The denomination of which it has
taken the place is Procureur. The word a word of Rome bred law procureur was
significant and characteristic: what it signified was a person
who takes care of a certain sort business of a certain sort for another.
There were accordingly, two sorts of procureurs – the procureur
all litis and the procureur ad negotia. But under
Rome bred law the two sorts of functions or services having
fallen into two different sorts of hands the denomination procureur
was retained by him whose business consisted in acting instead of, another
or as assistant to another
on the occasion of a suit
at law, which the denomination
Notaire was
assumed by him whose
business consisted in acting
instead of or as assistant to
another on the occasion of a
Conveyance or a Contract.
