The denomination avoué if at all significant
and characteristic is much less so than the denomination procureur: it meant one man who was acknowledged by
another: acknowledged? how in what character? in the character of
one who employed by him to act in his stead – employed by
him to act as procureur: it was therefore no otherwise
characteristic than in so far as it served to convey the idea
conveyed by the word procureur. What then can have been the
cause or use of this substitution? It was plainly no other than
this – namely that by the word procureur a conception sentiment
of dislike towards the person bearing that denomination had
become associated. Of this dislike the cause was more
natural than reasonable: by from the malpractices of the person
so denominated mischief and suffering in vast abundance
was seen and f by their employers seen and felt: but of this
malpractice the authors were – not this class of lawyers but
that of the Judges: for the Judges were the persons by whose
power that system was organized of which the procureurs and
other professional lawyers were but the instruments. Under
Rome bred law as under English bred law between all official
lawyers a là un part and all professional lawyers on the other part this was
was under English bred law in high perfection there still is – a community
of sinister interest and consequently a correspondent
inclination to betray their trust by serving themselves in unjust
ways at the expence of those for whom they act: but
had it not been for the Judge, on the part of the professional lawyer there would have been the
inclination only not the power: by the Judge only, by means of
the co-operation or negligence of the legislator could the power have
been added to the inclination
