But under favour of the power and fictitious dignity and comparative
of him with
with which the official functionaries were
essentially invested and the comparative opulence and factitious
dignity which by means of it they contrived to add to it,
they escaped from the kept their shoulders free from the load of
odium and opprobrium and left it to be exclusively borne
by their professional instruments and partners in guilt and
profit.

The English bred denomination Attorney was in
its origin no not less significant and characteristic than the Rome bred denomination
Pro Procureur: what it signified was, in like
manner a person who on the occasion in question acts
in the place or stead of another to wit the party whose
interest is at stake in the transaction whatsoever it be. It accordingly
was and continues to be applicable and applied
not only to litiscontestational but also to non-litiscontestational
transactions: witness in as in the case the cas sort of instrument
called a power of attorney: by which one means of which
one any person gives to any other whether a professional
Attorney or not the power of acting on the occasion in question
in his stead. Of late years the denomination Attorney has in
England nearly vanished: the altogether uncharacteristic denomination Solicitor having proportionably
taken crept into its place. Of this change another cause may
be seen in addition to the French cause abovementioned: Solicitor
is the term denomination that had been exclusively assumed by the Judicatories which
by which the denomination Courts Equity Courts had been assumed. The
service which the Judges of those judicatories undertook to give was the granting
relief from the severity exercised
by the judicatories
by which the denomination
of Courts of Common Law
or briefly Courts of Law
was retained.
