2. To misdecision it contributes in a manner not less
contestable though not quite altogether so obvious. It In addition to
the what is done by keeping the suitor-client the client suitor
out of the sight of the Judge, it gives to juridical falshood designed and undesigned and thence on the part of the Judges misconception with prodigious efficiency
copiousness and success. The suitor being debarred from all immediate communication
with the Judge – the Judge debarring himself from
all immediate communication with the suitor, no information
passes from the one to another but through a cloudy and
impure medium, by which is in infinite variety of proportions
falshood is mixed up with when it is not compleatly
substituted to truth. The Client by his passions
or his sinister interests and designs, begins well delivers himself: he
conveys to his advisor a too favourable to those
in those designs – unfavourable in proportion be unfavourable accordingly to his
interests. the his adviser if be even a gratuitous one would
if his understanding enabled him see through the deception
and shape his advice accordingly and put a stop to the present
or as the case may be the defence. But as to the
paid adviser it is not his interest to see through any such
deception: if he does see through it it is without any endeavour
so to do, it is clear as it were in spite of himself: and let
him as though it ever so clearly, it is not natural that
he should communicate the discovery to the his client. By such communication
he would, supposing the object of it attained put an
end to the suit therewith to his own profit, and not improbably
without gaining reputation by so doing – not probab gaining calling
forth not very improbably or unfrequently instead of gratitude
and respect displeasure by the use as the fruit of the truth.
