III. Notaries. In the case of the Notary class the question
between separation from the two others and aggregation in relation
to the two others is not of equal importance. If separate from
the two others, a the question might more easily have place, whether they a person should
who had been served or aggregated to this class or should not be admissible into the class of Judges: but the answer
is in the negative. True it is that in this case the sinister
interest and consequent habit and propensity is not so strong has not that strength as in the case of the Advocate or the
Attorney: not the less true is it that in their case a sinister interest
has place. It is the interest of the Notary that his of instrument
of which he has the drawing should be as lengthy as poss the
length be maximized: payment being naturally in proportion
to the length.
If he is himself also an Attorney it is his interest
as it is more or less in his power to in his character of Notary
to make business for himself in the character of Attorney: to
render them in maximize their obscurity, ambiguity
and prolixity for the purpose of maximizing the probability
of their giving rise to suits in which he may in his other character
be employed.
The nature of his business not being such as to give
engage him in argumentation, he is not engaged in any such
habit of falshood and misrepresentation as that which is inseparable
from the functions of the Advocate.
In comparison of that of the Judge his field of action is
so narrow as from that cause where to put an exclusion upon the
admitting him to the exercise of that Office so long as others whose
business has habitually carried them through the whole of the field can be found.
