Instructions

Thus between the three several branches of the profession
of professional lawyers between one and another of the
three commonly established classes of professional lawyer
there is this gradation has place is observable in respect of the quantity
of sinister interest.

1. The least is that which adheres to the profession of
the Notary. It is his interest to maximize the lengthiness of his instruments,
– but it is not his interest to render them obscure or ambiguous,
except it be in the a case in so far as by such obscurity or
ambiguity an effectual demand may be produced for ulterior
instruments ones. In the creation of delay or vexation
he has no interest: on the contrary with by and in proportion the exclusion of
evil 2 in both those shapes he receives a proportionable benefit.

Next above on the scale of magnitude of mischievousness stands
the sinister interest of the Attorney. In common with the
Advocates his sinister interest is promoted in the rate of the quantity
of delay vexation and expence: of expence for in respect of the profit extracted
by him out of the expence; of delay for the sake of the
incidents by with which it is pregnant, incident all of them contributing
all of them to the augmentation of the expence.

3. Above both stands the situation of the Advocate. In
the sinister interest of the Attorney he is a sharer has possesses
a share without any precise distinguishable difference as to the
comparative magnitude. But whatsoever falshood and misrepresentation
comes to be uttered in the course of the oral communication
with the Judge, it is, by the Advocate alone, by the Advocate
any not by the Notary nor even by the Attorney, that it is uttered.
