§. 6. Remuneration
Instructions
If, in comparison of what it is in the country most
lauded for its judicial system the average quantity of emolument obtainable
in the situation of Professional Lawyer were not in a
great degree reduced, as well as the sinister emolument of Judges wholly through off the general denial of justice would
still continue to press upon the great majority of the people.
In the effecting of this necessary reduction
By whatsoever fixed by fixation of prices regulation – that is to say
by appointment of a fixed sum for each sort article of service – by
this expedient if it stand alone, in no other than in a
mass of very inadequate manner could such this desirable effect,
however, be produced. Written pleadings paid at so much a
for so many words being altogether out if incompatible within
any system of procedure, compatible with this Code
and of written instruments of procedure all such as are
in their nature susceptible of general application, being provided
for by printed papers with blanks for the individual
parts of the matter, little would remain as for the subject
matter or charge but besides the time employed on each occasion
in the business: and how impossible it will difficult it must be, not to say
impossible to ascribe for preascertain for the purpose
of fixing the remuneration what shall be the quantity
of time necessary to be expended in each individual suit
in the performance of each individual particular business
for which there shall be a demand in each individual suit,
is sufficiently manifest.
