§. 7. Securities for appropriate aptitude
Instructions
II. As to Securities at large. On this occasion
with a view to moral aptitude, the duty of the professional
lawyer in his capacity – the duty to speak for shortness – may be distinguished
not to his duty to as towards his clients: 2. his duty as towards
his Client's adversaries. By his duty as towards his Clients
a veto is put upon all wrongs on his part in so far as
his Clients would be sufferers by them: by his duty as towards
their adversaries, upon all wrongs by which those same Clients
adversaries would be sufferers.
As to what regards intellectual and active aptitude it the interests
affected by it are if not exclusively more particularly those of his Clients
than those of their adversaries. In proportion as in the system
of Procedure belonging to this Code publicity as applied to
the conduct of every functionary is maximized, in particular so with the
case of the functionaries now in question will it be. Whether
it be as assistant to his or as substitute the conduct proceeding
of the Professional Lawyer will be open to the scrutin
either carried on before the eyes or in a more especial particular
manner open to the observation and scrutiny not only of the Judge,
but of the several me several other actors in the judicial
theatre in particular to those suitors parties in other suits
who are in the Judicial Inspectors Gallery in quality of members of the Public Opinion Tribunal, in attendance and waiting to have their suits
called on.
