§. 7. Securities
Instructions
As to their moral aptitude, so far as it relates to
their duty as towards Clients, the security afforded by the
power of the Judge is more decidedly and uniformly favourable to it, than
the security afforded by observation eyes of the public people at large
in their capacity of future Clients. If to him
who is conscious of being in the right,⊞ ⊞ as well as to him who though not actually in the right regards himself as being so, profits on the part of
his lawyer is a naturally desired quality requisite, not less
to him who is conscious of being in the wrong, is
his opposites species modifications of improbity an instrument of recommendation
and an object of favour and . The
more enormous and mischievous the malpractice sinister artifices
he is willing to produce for the benefit of his client, the more
and will his assistance be to relatively
dishonest client.
But under the here proposed system, the influence which
to all purposes favourable to justice the Judge will have over on the conduct of the
professional lawyer, is maximized. As the Client will be responsible
compensationally satisfactionally as well as punitionally responsible
for at large so will be his professional helper
be for insincerity: and it has already been in which case
exampled proportion his conduct is kept open to the observation
of the Judge there has just been occasion to observe.
