Constitutional Code. Ch. XXI Lawyers
§. 5. Class one only Capacity as to offices
Art. 1. Under this Code A Judge is not a Professional Lawyer. A Professional Lawyer
can never be a Judge.
A Judge is not a Professional Lawyer: for here be any every
such appellation. The For the With interest of the and the interest
of the Lawyer is adverse opposite and irreconcilable. It is the
interest of the Suitor that delay, vexation and expence be minimized:
it is the interest of the lawyer that for the sake of the profit
and of the expence it is the interest of the lawyer that all be maximized:
to act for the sake of the profit out of upon the expence.
In the lawyer situation of the lawyer This sinister interest of is natural and internal: it can not be done
away. In the situation of the Judge it is not internal: it
may be kept aloof: it is so endeavoured so to be as by this Code. Wherever it has
place it is factitious. To Judges with In confederacy with other
bad rulers the Judges have contract to give it to themselves.
Elsewhere the Judge is powerful to do evil: weak, could
it ever be his endeavour, to do good. Here he would
find himself powerless should ever endeavour to do evil.
He is has more powerful power than he ever was had elsewhere, as
well as more inducement to do good.
