§. 5. Dispunitive function
Enactive. Instructional.
Art. 6. 2. Ground the second. Service, expected to be
rendered by the convicted delinquent convict, by information given
having for its effect the prevention of otherwise future acts
of delinquency.
Care Adequate assurance will, on this occasion, require to be taken entertained obtained
not only that by means of the information thus afforded by the convict
that, but for the information thus afforded by the delinquent the offences in question will have been prevented, but also that without it, they
in question the offences in question would not have been
prevented: and, accordingly, that, with the privity of
the delinquent, he himself not having himself been able to
communicate the information, another person the information,
the delinquent was not with his privity, by such some other person
who had been become possessed of it, made the channel
of communication, for the purpose of his obtaining for
him the remission of the punishment.
