Constitutional Code.Ch. XXII. Justice Minister
§. 5. Dispunitive function
☞ Qur as to these Examiner
16. In the Spectator or Examiner of Saturday the 17th 1831,
it is stated – that, on the occasion of a conversation, in the
House of Lords, on the subject of Dark Punishment, Lord
Tenterden Lord Chief Justice of the King's Bench, spoke of it
as an ungrounded notion – that, among Judges, the recommending
it to Juries to declare upon their oaths the
value, of goods stolen, to be inferior to what every body would
fail to see it to be without exception could not but see it to be – to what they
could not but know it to be, was a common practice.
From the Supposing this statement report correct, from such was the hardihood,
manifested, in the denial by a man in that situation, at liberty that place
to who in that situation could give utterance to an assertion, which
in the people at large by everybody who had, in any degree,
taken cognizance of to the subject can not but be seen to
be a wilful falshood: and hence may a conception may be entertained
of the degree, in which, the to men of that class, the person
doing evil in this shape is dear to their hearts.
☞ Give then an account of such undervaluation from this
same paper.
