Art. 5. So numerous and important as hath been seen, being
the functions attached to the situation of this highest functionary
of the Judiciary Department, so abundant large the quantity of
time which the due discharge of them would naturally
call for the occupation of, – that only in case of necessity
should the exercise of the Judicial function be called for
at his hands. Extremely rare will accordingly (it is
supposed) be found, the occasion when added altogether, the
occasions, in which, on the part of this head of the Judiciary
Department, or as the English phrase is – head
of the law, exercise of this function will have to be
performed. As often as it is performed, it will be
seen the nature of the case will show – which of the those securities
– and without much danger of doubt or controversy, of the several Securities
which apply to the case situation of a Judge Immediate, will
which are applicable to the it with advantage the situation
here in question with advantage.
