Procedure Code
Means of eliciting truth
For coming at the truth for the purpose of judicature
there is but one most apt mode: for in suits of all
sorts it is the same. The English system for every species
of judicatories established a different course, the of these the
number is enormous is such as baffles enumeration and in a manner infinite: and they
all vie with each other in the studied inaptitude. In the race
of inaptitude this our English is out run by the Scotch Judicature: and both together are headed by the English British House
of Lords.
Infinite is the entanglement of these Judicatories
one with another: and of the enormous list of causes of
factitious complication this is one.
Delay: English judicature
In differ the English system different operations are
appointed to be performed at different successive points of time
each point is a fixt point. Necessary consequence too time
too great much or not enough in every case but one.
Either factitious delay or factitious precipitation. The
factitious precipitation has its remedy to wit by factitious
and excessive delay obtainable by factitious expence:
but to the factitious delay there is no remedy: not even that
sad remedy.

Mac Boston on Case Marked II. as 127. "The rules of evidence
"being founded upon the immutable principle of justice and established
"for the discovery of truth, can never vary with the forms and
"jurisdiction of Courts....." He adds Common Law serves the standard for military Courts.
