Procedure Code
Ch. or §. 3. Means.
Art. 1. Correlative to the above mentioned ends are
the moral objects that which now to be considered in under the
character name of means: they are means of operations means of operation for the accomplishment
of those same ends.
Ranged Considered in the order of design, they may be thus
enumerated 1. means of execution: 2. means of probation
3. means of communication. 4. pursuit Judicial suit or pursuit. 5. application 5. judicial
Ranged in the order of practice they will stand
thus – 1. application (judicial application) 2. pursuit (judicial
pursuit). 3. Means of Probation 4. Com for a judicial
purpose. 4. Means of Communication for a judicial purpose.
5. Means of Execution for a judicial purpose.
The application is the act of the individual alone.
The person Of the pursuit the commencement is the joint
act of the applicant and the Judge: the applicant demanding
to be admitted pursuer for the purpose of giving commencement
to a the suit and the Judge acceding to complying with the demand
and admitting him accordingly: or the Judge
on having the application seeing reason to cause for the
benefit of the public or some individual or body of
individuals any reason to cause him to perform the
function and service of pursuer, and if necessary
compelling him so to do.
