Procedure Code
Reason-expounding that
Art. 5. Every such reason will consist of an
indication given of the subserviency of such course or
in step to the ends of justice, direct or collateral, one or other of them.
Balance-requiring Rule
Art. 6. In case of conflict, such course or
step will not be warrantable warranted but upon the supposition
that the evil good produced by the contravention of subserviency to the direct
ends is likely in all likelihood to be greater than the evil considered produced propinquity and probability resulting from about to result
by the contravention thereby made of the collateral ends of
justice: or vice versa that the good produced by like reason resulting from
the subservience to the collateral ends of justice is greater
than the
evil corresponding and opposite to the direct ends
of justice: or what is the same in the words, that
the evil likely to be avoided by the pursuit of the direct ends of justice
is less than the evil likely to be produced by the contravention
made of the collateral ends of justice.
