Procedure Code
§. 3. Means of execution – immediate ultimate and instrumental
means or preparatory means
First source of division – relative of the operation in
question to the Note 1. in which is object hence the description of the suit – operations
immediate or ultimate, and operations preparatory.
Art. 1. Immediate and instrumental preparatory – the
distinction which these adjuncts may serve to bring to view,
must not passes pass unnoticed. For though by in the
appellation words means of execution, those here designated by the
appellation of instrumental preparatory would not scarcely without
explanation notice be looked to regarded as included, yet are they not
with less propriety included under it than those are which to which
are designated distinguished by the appellation of immediate are allotted: for, suppose
the instrumental preparatory wanting no such result as that
signified by the word execution could can have place.
Art. 2. Means of probation, and means of
communication: under to one or other of these appellations
will be found referable all means of execution not comprehended
under the denomination of immediate: and in
Art. 3. Means of probation. Under this opera
appellation may and will be included evidence themselves sources of persuasion,
or in such one word evidences themselves, but moreover
and all such operations and instruments as employed applied
or applicable or employable for to the purpose of presenting them to the
cognizance of the Judge.
