☞ Addend. Means of communication last
On the occasion of the other the characteristic operations the
communication must be considered or effected.

In a case such as the present, the order or method pursued
may be either chronological or logical. Both The logical may have
their its use: the chronological is indispensable and unrejectible inevitable.

In the chronological method the operation the operations of all sorts
and by what persons so ever performed are brought under
consideration in the order of time: those first which come first
to be performed, and so on to the end.

Even the logical constituted as it is by divisions and subdivisions will be under the necessity of
taking the chronological for one source at least of those
same divisions. Witness the sketch following.

The Of judicial procedure the operations are either
characteristic or uncharacteristic.

Those which are The characteristic are either 1 consummative, or 2 non-consummative.

Those which are not consummative are either 1. institutive
or 2. continuative.

By the non-characteristic under those whi by which
for the purpose of those which are characteristic communication
is made of the subject matter necessary, communication from
person to person in the same place, communication of person or thing; 3. communication
to wit of such person or such thing from place to place. Uncharacteristic may
be not improperly be termed the operations by which such
communication is made: for the need of them has place
not only in all political business judicial included but in
the whole business of life. In judicial business they it
will however at the same time require to be attended to with peculiar
. The In most other businesses the object of all parties
interested is to promote communication in all its modes and for all
purposes. But in judicial procedure as in war, no small part of
their industry will be employed approached in the prevention of it. So in particular
it will be in the part of
all insincere litigants in
general, and more especially
those on the defendant's side.
