Not known on the application
whether pursuer will be defendant
Of the aggregate mass of the appropriate objects
the division being thus made – made in the order which
may be called logical, chronological is the order in
which they the purposes of this enumeration requires
them to be considered. To one or another of the genera
generalissimo exhibited in the logical arrangement all those which follow
continued in the chronological arrangement will be seen to

In On Stages 6. Initiatory application. Of the operation thus denominated
mention has already been needed and accordingly
made in Ch. Stages. In the application applicant may be
seen the actor or operator; in the application the operation:
in the writing to which the discourse
delivered by it is consigned, the instrument.
The sort of application in question can not be made
but as service, and eventually two services are demanded
by it. If as above explained Ch. the application be, as above explained uncontentious,
service by the service of one person it may receive
the satisfaction it aims at: that person
the Judge: interior, the distinctive character and denomination of the service:
if contentious, there are then two persons in whose part
hands a service is applied for: the second person being
the individual who by the contentious character of the suit
is constituted, or at least endeavoured to be constituted, defendant
exterior the service demanded at his hands.
In a suit may now be seen an aggregate
of consecutive operations, by many of which will be produced
a correspondent aggregate of instruments.
In the By the institution of this suit the applicant constitutes
himself pursuer. Here then may already be seen two parties, and
as many sides. On the one side the a pursuer: and the side will thence be
called the pursuer's side;
on the other side a defendant:
and that side will thence
be called the defendant's
side.
