Ch. Nomenclature Classificatn
§.
In of the Chapter in Between the non penal and the penal set of suits the distinction
has already been brought to view: so likewise in regard to
penal the distinction between the purely public suit, and the public-private. To By the non penal suit belongs one sort of service is the object of demand is demanded
to the penal another sort of service.
Now come in the classification of wrongs: as also that of
rights. In regard to each, the source of distinction and division
is the nominal possession to which the thing wrong or the right bears
reference.
Body, mind, property, power, reputation – in these so many
distinguishable possessions is a man said to have: witness the
word his: witness the phrases his body, his mind, his property, his power
his reputation, his condition in life. So many of these
possessions, so many vulnerable quarters has he which
are exposed each of them to this re wrong: exposed each
if them to wrong in so many respective shapes and sets of
shapes.
But so many shapes as are the shapes of wrong as a private wrong is susceptible of
so many shapes in the that judicial service susceptible if by which the which
has for its object the applying redress to the wrongs
redress to the wrong is endeavoured to be administered applied to it
So many shapes is wrong distinguishable occasions are there on
which the correspondent exterior or effective or immediate service consisting in the
satisfaction for the wrong ought to be administered by the
wrongdoer. So many occasions for that judicial service, for
those the several aggregates of judicial service which may eventually prove
eventually necessary to for the causing those same exterior services
to be rendered if it be a public wrong so many of those shapes occasions
are as it assumes, so many are the occasions on which, the
public (not being susceptible of having any possible satisfaction exis having with the
exception of property any such possessions and vulnerable
quarters as those which the individual has as above) in which the public
in lieu of satisfaction has a demand for that service by which for the prevention of the like wrong punishment is administered.
