Procedure Code Ch. Nomenclature
Decree to wit judicial decree. Decrees, as already
stated see Constitut. Code, Ch. XI. Judiciary §. are of two sorts
operativeand comparative: expression operative an expressive of the an act
of the understanding; comparative expressive of an act of the
will; the former, in so far as the Judge acts otherwise than arbitrarily
constituting a ground necessary to the latter: a ground if not expressed
at any rate applied implied and upon occasion producible. As in Committed
to writing in the form of a separate instrument any
command or prohibition issued by a Judge as such constituting may be termed
a judicial decree.
