Procedure Code Ch. Nomenclative Classification
Contestation – Litiscontestatio are the Roman
name. Hitherto whatsoever has been brought to view
may have had place without contestation – without
dispute, in this way under the generally established
systems, it will always have happened, where he
against whom on whose person an attack has been made in the
name of a pursuer, is destitute of the means of
judicial self defence: that is to say in the vast majority
of suits.
But where contestation has once begun, and the

same game which had been played before on one side

side this will be the case, and, especially if there be
also insincerity on the pursuer's side, probation and
for various that and other purposes communication will meet a second time
be encumbered with with obstruction and difficulties corresponding to those
above alluded to. He who with reference to the principal

service demanded at the commencement of the suit was
the object was pursuer, may in respect of any number
of incidental demands, spring out of the original
one, and made upon him by the defendant, be placed in
the situation, and reduced necessitated to act in the character the part of

made in the original denomination of the suit, as taken from the
situation of the parties with reference to it.
