Procedure Code Ch. Nomenclature

41. Means of probation. 42. Means of execution. 43. Means
of communication for both those ends and purposes: 44. Means of
seeing obtaining and securing forthcomingness for all three.

As to forthcomingness, the defendant being by the supposition
in a state of forthcomingness, and that to the effect as well as
purpose as well of judicial probation as judicability,
means applicable applied and adequate to those several purposes
has therefore by the supposition been in existence and been
employed.

Those means will has have been either direct or indirect.
The supposed forthcoming object being a person by the direct means are
which apply to his body, and which as such may be termed designated
by the appellation of purely physical – for the production of the effect by
those means no application being necessary to be made to his mind.
Means applying to the mind are inducements motives.
These inducements, to be effectual must have been also of the
remunerating remunerative or of the punitive kind. As to remunerating, they are
here out of the question case: for though for obtaining the
and
testimony and attendance of an extraneous witness remuneration
may be in many cases necessary not so in the case of a party defendant: for in that case, unless distinction of all will
pursuers form in respect of his claim a demand, they would in relation to the defendant in the character
of success at any rate in any case necessarily absurd and unavailing.

Remain those which are of the punitive cast. Of the
few diversifications of which these are susceptible, mention has
already been made as above.

If pretence applying to the body was at the means employed
the inverse only that which applies to the mind alone,
and acersitive for the later to call in someone is
the a name that may be given to it.
