Procedure CodeCh. Nomenclature

So far as either subjection to punishment – say in one
word punishedness is the object which aimed at in the accersition
is aimed at, or subjection to the obligation of yielding testimony
in a the in the word of mouth form and subject
to interrogation, or compliance possession of the person for the purpose of producing
to interrogation positive action for any purpose at his demand nothing but actual forthcomingness – personal
attendance say actual forthcomingness can come up to the
purpose. But if the object aimed at by be of any sort other
sort than those, compliance without forthcomingness personal attendance may in
that case answer the purpose as well as forthcomingness such personal attendance,
and in the case of the word forthcomingness be employed
in both cases physical or actual men will be the adjunct by which the mode
of forthcomingness is distinguished in the one case,
virtual in the other case.

Apply this to the purpose of probation If this distinction be admitted, thus of probation be the
object in and in the view to which the forthcomingness in this extended
sense is required desired, physical will be the mode of forthcomingness
necessary if word of mouth oral testification at the judgment
seat be what is desired, virtual while virtual will answer the purpose,
if all that is desired is testification in the written say
the epistolary mode.

Forthcomingness then – actual forthcomingness of the person is in spoken of as forthcoming at whose hands punishedness or oral probation at the judgment seat is desired
so far as regards corporal punishment no not only a means
of execution but the only immediate means: so likewise as to probation as
far as regards such probation in the oral mode. So is may it likewise
be a means of execution in the case where punishment
other than corporal, or satisfaction at the charge of the forthcoming
person or any other person who to the purpose in question
is subject to his influence: but in this case not in an immediate
way but in an unimmediate: for example by
causing him to produce for the purpose in question, forthcomingness
on the part of such or such a specific thing, or if on
the part of the sum of money due; in this case the immediate purpose for
which it is needed and to which it is applied is that of compensation.
