Procedure Code Ch. Nomenclature

This brings us to we are thus arrived at forthcomingness considered with reference in regard to the only
remaining sort of subject matters – to wit things.

On the part of a thing as on the part of a person
forthcomingness may be to any one of the above purposes – execution
in regard to punishment, execution in regard to satisfaction,
attendance for the purpose of judicability, and thereafter eventually for the purpose of punishability or administration of satisfaction
as likewise probation a means either immediate or unimmediate,
in the latter case by producing the through the medium of compliance,
the purpose for which and the effect with which a thing may be
brought is endeavoured to be brought into the presence of the Judge
may be 1. its being transferred to the pursuer demandant in consummation
of the inchoate right he has to it 2. in part satisfaction
for the wrong done to him by taking it out of his possession,
3. in satisfaction for wrong done to him in any other shape,
4. or to the purpose of being consigned to the charge of the Government
Advocate for the purpose of punishment in respect of the
suffering caused produced by the and loss of it, or 5 to the purpose of
its furnishing officiating by means of the inspection made of it, in the
character of a source of real evidence: or 6. as a means
of inferring compelling compliance by the apprehension of the loss of it:
compliance for any one of the purpose some purposes as those just mentioned.

Forthcomingness of a person may be a means of compelling
at his hand the forthcomingness of a thing. The forthcomingness of
a thing may be a means of compelling forthcomingness on the part
of a person to whom the property or custody of it belongs.

Forthcomingness of either of the two objects is a means of
securing forthcomingness of the other: and that for to any of the purposes
to which as above forthcomingness is in both cases applicable: actual forthcomingness a means but not
the only means.
