Procedure CodeCh. Nomenclature

All this too without conclusion – without adequate
proof: that is to say adequate to the purpose of actual
execution of the proposed contemplated ultimate decree: for if to that
purpose the proof were adequate, now would be the time
for such actual execution – the means of and the means
required would be the means of actual and absolute not the means of
eventual execution.

Were it not for two circumstances How then would be so much flagrant injustice
punishment or what is tantamount to punishment first
in the first instance proof real or no better than supposed
and pretended afterwards.

The circumstances are these

1. As a condition precedent to such suffering
indispensable afflictive acts of power, responsibility – adequate responsibility
at the charge of the person in whose evidence
they have for their ground.

2. As an alleviation subsequent, the cessation
of the afflictive state of things whensoever the as soon as ever adequate security
for the subjection to , effective execution in the event
of which appropriate and adequate probation – security which being though less
afflictive shall at the same time be regarded as adequate,
probability of adequate probation being at the
same time taken into account.

But on the part of the applicant, even if accusant
still more if simply informant the finding of such
security if it extend to anything beyond his responsibility
satisfactional and punishment in the event of wilful or rash
falshood is itself an affliction: more especially if in
the case of accusation neither satisfaction of the lucrative to himself as
punishment and with it satisfaction of the vindictive kind shall
at the last have had place; in either of which cases the damage to
him, the damage on that side of the suit also will may have have been irreparable.
