Of Accersition, Mission and Prehension Accersition and
Mission: or say Of Judicial Location including Prehension
Accersition and Mission

§. 1 Expositive

Art. 1. Distinguishable and requiring to be distinguished from Constitutional
is Judicial location. In the case of Constitutional location the sense in which
the word place – For the purpose of giving execution and effect to the operation of lodging the subject matter in that place – is
that portion which is in question fr is to be understood, is figurative,
in the case of judicial location, literal.

Whatsoever be the portion of substantive law to
which on the occasion in question execution and effect
requires to be given, for the accomplishment of this object
it will be necessary that the subject matter of judicature the judicial
operation
whatsoever it be, a thing or a person should at a
certain time be at a certain place.

If it be a thing For this purpose, if it be a
thing there is but one mode of operation, to wit physical
force: say in this case prehension. But by the performance
of this operation, the object is not yet effected: the
operation is but preparatory: preparatory to the ultimate operation
by which the requisite and appropriate location is effected: the thing in question is lodged
in the place in which for the purposes of justice it is necessary
or requisite that it should be.

This place will be either the place at which
the thing is found occupying or some other place: if some other place
then the place from whence the locative judicial mandate
issues, or some third place this third place will be either determinate or indeterminate. In the first of these three cases
the result will be sistition staying the thing in the place where it is found
in the second case, adduction, in the third case transductiin
or say transmissiin; in the fourth case, abduction.
