§. Exclusion improper causes

3. Usefulness. Receive the in favor of the pursuers side his own the pursuers
testimony, and at the same time in favour of the Defender's
side the defenders testimony, testimony relation to the relevant and material facts will commonly
be received or extracted and thence the facts established in
the cause if the first one and the same hearing and that
hearing the first and only meant hearing: and thus at the
close of that same hearing the suit brought to a state of
maturity with relation to a definitive decision, and as often
as this is the case the vexation and expence that would have
attended been produced by the examination of extraneous witnesses is all saved
as well as the vexation and expence that would not have been attended
been produced by the attendance of the parties.

Art. To exclude the testimony of a party is to leave
the commission of all wrongs inju inflicting on him injuries
in every imaginable shape, in every case in which he
is present at the occasion including all those of which his
person is the subject and no other person is in every
case in which no other person is present on the occasion and
he is.
