If the above observations appear well grounded, and the
corresponding arrangements well adapted to the ends of justice
the more eminently so the more more ill-adapted will Jury
trial in these particular be seen to be. How soever compleatly unconnected
and reciprocally irrelevant any so ever how is any greater
number of facts with their respective credence may be seen to be, all must be jumbled
together in one statement, and probabilized on the one part proved to and disprobabilized
on the other at one and the same sitting ahd hearing
and also at one and the same sitting if possible: how to order choice
is substituted and to adequate inadequate comprehension in
all minds.
