Procedure Code
☞ This may form a useful supplement to the Procedure Code
but can scarcely be said to belong to it.
§. Caution to individuals, as to preappointment and conservation of evidence
1. As to preappointment. In the case of a Contract
or Conveyance of any kind without writing beware of the
disadvantageousness of the situation in which you stand
if while you are without witness, the other Counter party has a witness
or witnesses – has for percipient witness or witnesses
a person or persons who by interest or affection are likely
to be pushed to his side: in particular a known Agent or Agents.
2. So if while on your side there is no one but
yourself, on the other side there is not your adverse ,
but an Agent or Agents. For, the partiality of an
pri Agent for the interest of his principal not being so sure
as a mans partiality for himself, the probative force of his testimony,
will ceteris paribus be naturally regarded, as
proportionably superior to yours: the degree of confidence placed
on it by the Judge will be greater.
Of The modifications which on such an occasion
equal justice requires are one or other of these:
1. To the party on neither side any extraneous witness
2. To the party on each side witnesses in the same number
3. To the parties on both sides witnesses one or more
possessed of the joint confidence
