Procedure CodeCh. VIII Iniatory hearing
3. In that which is recognized as belonging to
criminal and penal law that which has for its object the
security of property against depredation at the hands of indigence.
Theft to with with its aggravation, highway robbery, house breaking
robbery and Nocturnal house breaking robbery. Added to
theft on this occasion might be its of , and in
some cases distinguishable for it – to evil.
Fraudulent obtainment – obtainment of property on false pretences.
Of this genus species of crime forgery as also applied to
those purposes to which it is most applied
is but one a modification: forgery at large being itself but
a modification of what the call a crime
perjury being another: and each of them being an instrument
capable of being employed in the of crime
in any other shape whatsoever.
In vain would The absence of the particular appropriate document in this case
be urged adduced as a reason for not forbearing to render to the ends
of justice the service which the instrument of which it should
make a part is to render. In vain would The impossibility
of doing everything be alledged as a reason for doing nothing.
True it is, that Compared with the a text of real law a test of imaginary law
would will at best be but a miserable makeshift.⊞ ⊞ Not a syllable of
it but might be taken
for a subject matter
of contestation by
the proxy as assistant
on the other side: especially if conductitious. Still
however the aggregate instrument will be better with it than
without it.
