Procedure Code
Art. 9. Where the cause of transference is in the station of
the facts it will consist in the intransferability of the service
of real evidence to the Justice Chamber.
Art. 10. The cause of such intransferability will
be either the physical impossibility or the ineligibility of
such transference.
Art. The ineligibility of such transference will
be constituted by the superior magnitude of the evil correspondent
and opposite to the collateral ends of Justice – delay,
expence and vexation, compared with the evil if any, produced
to the direct ends of justice, in that suit or
in other suits at large, by the necessary length of the Judges absence
on the part of the Judge from the Justice Chamber – the statutory
seat of Judicature.
