Cause the th Multiplicity of instantaneously succeeding
It eventual Pursuers and Defendants
Such is the state of things produced by a Bill of Exchange.
By one and the same instrument of contract passing,
as it may do through any number of hands in that same
number of successive instants each may be eventually placed in the double
capacity or say character of pursuer and defendant, if pursuer,
the value at the hands of the last antecedent possessor
and so on through the whole line of antecedent possessors: if
defendant at the hands of the next subsequent possessor, and so
on through the whole line of subsequent possessors.
In case of loss, the immediate cause of loss will
be non-payment by the last transferrer to the last transferee.
What presents itself as reasonable is – that by all the
several persons who have successively been successive transferees and transferrers the with or without the
last transferee the loss should be borne in equal share.
For this purpose of living in the same Immediate Judge's
territory they should all of them appear attend together in the Justice Chamber
in the presence of the Judge.
