Procedure Code
§. Reasons for postponement of Defendants attendance or accersition
Art. Reasons, adequate or inadequate, for hearing
persons one or more before the a Defendant is heard may
be as follows –
I. Reasons for furtherance the benefit of the pursuers side and
at the charge of the Defendant's side.
1. Danger lest, it not being thought necessary to take preliminary
security at his charge, he should if apprised of the demand may
at his charge take effectual measures for evading compliance.
II. Reasons for the benefit of the Defendant's side.
1. Expectation that by on further application examination of person
or of or persons on the applicant's pursuers side, it may perhaps be
found needless to burthen him with the vexa expence and
vexation incident to attendance or epistolary response responsive statement
and with or without testification.
2. Expectation that although it should be necessary so to burthen
him with the expence and ve yet that by previous
augmentation of the stock of evidence on the pursuer's side, and
communication thereof to the Defendant, his means of defence
may be rendered more nearly adequate, and the production
of them rendered less dilatory than of he had had responsive
statement, with or without testification had been to have been
required of him upon communication made to him of the
demand and evidence of on the pursuers side in its
first and less mature state.
Note that on this occasion if on the Defendant's part attendance or satisfactory response
be not received do not take place, execution at his charge must take place except
that in case of attendance in consequence of prehension he will by that means on that occasion
possess the means faculty of making defence.
