Termination of a Suit
§. 1

Art. 1. Different suits have of course different
termination. A suit has received its termination
on the defendant's side in favour of the pursuer's side
when either execution and effect has been given to the
decrees by which the performance of the effective service demanded
by the Pursuer has been would be effect, or the giving such execution
and effect has been found and declared foun
to be, either ultimately or for an indefinite time
impracticable.

Art. 2. According to the nature of the benefit and correspondent
service demanded by or established conferred accorded granted by the suit is accorded
by the Judge, and the correspondent burthen borne by the rendering of the service, the termination will be either consummate unprotracted
in the first instance, or protracted and continue,
in which case the termination itself will have its commencement
and its termination: it will be inchoate and
consummate. In so far as the burthen has the effect of
a punishment it the suffering may in the manner of a be distinguished
into not acute and chronical the
case an acute case or a chronical case.

Art. 3. Instance in a non-penal suit case.
Termination Conclusion unprotracted all at all at once delivery, of the valuable thing demanded
payment all at once of the sum demanded and adjudged due.
