§. Costs.

Natural and factitious together, costs are an
instrument of mischief in the hands of the dishonest insincere
suitor on both sides of the suit. On the plaintiff's pursuer's side
they enable him to acquire at the expence of the
intended victim which is whatsoever portion is it be or the property that the
oppressor he is desirous of acquiring, deduction
of that part which is in the course of the
process is swallowed up. In his character of pursuer The plaintiff puts in his groundless
demand: the defencs the victim also for this purpose
is stiled defendant; but who for want of pecuniary
means is unable to act in that character,
inactive: judgment giv conferring in the plaintiff
the maker of his demand, goes against the defendant
of course. If, with trusting to the goodness of his
cause, and informed of the amount of the proposed gulph that
yawns
for his property, he takes the first shape in his
defence, but without the means of continuing it to the continuing and
bringing it to a conclusion, his suffering is still worse:
worse by the whole amount of this expenditure,
and this case is perhaps no less frequent than the other.

2. Of the defendants side of the suit, it the oppressor acts in a
manner which though correspondent but is considerably different. He takes
measure of the pecuniary circumstances of those with whom
in the character of debtor whether on the score of contract
or on the score of injury in any shape he has to deal
with. To those who besides having the law on their side
are fortunate enough to have at command evidence
sufficient apt in quality as well as quantity to furnish a
legal proof of the fact on the ground of which their several
demands rest, he pays, though as late as may be what
is respectively due to them,
