§. Costs.

Costs says one observation as delusive as it is common
operate in discouragement a check of litigation: true, on
the part of the relatively sincere honest man who if he had
the means would on one side or other have been
a litigator, they do operate as a check to it, and
so effectually as to be a preventive an adequate preventive. Not less true is
it that on the part of the insincere and dishonest litigant,
so as he has but opulence and resolution enough
to avail himself of the instrument of evil which the law
has offered offers to his hand, so far from being a check
they operate as an instrument and as a one members spur.

But of the whole of the cost of which they are compose the instrument
this of which the sum of which lies in those seats
of judicature so miscalled scale of justice this is
but a part, nor that the greatest greater part. The injured oppressed
man destined victim who on measuring his means of defence with
the means of legal oppression which at the command of the
oppressor, finds resistance hopeless submitts without resistance:
In England in this case situation are at least nine-tenths
of the people with relation to the other tenth. Those in Taking
favour of by those for darkness to them those who are rich enough to buy the use of this
instrument the appellation of the rich and to those who
are not rich enough the appellation of the poor, thus it is
that by the law of the land a tyranny of the rich over
the poor is by the law of the land established. As it is
the oppression would be galling enough: it would be abundantly
more so were it not for that moral sanction
in which the evil produced by the misapplication of the legal
sanction finds its only efficient though so far from sufficient
check: the scrutinising eye of the Public Opinion Tribunal will
not men to be quite so depraved as those by whom the
power of the legal
instruments is exercised
