§. Costs.
By it distinction which is on every occasion in the matter
of lawyers may serve to bring to view a part though but
a small minute part of the whole number of instances in which
decisions known to be wrong have for that very purpose
been pronounced and continue to be pronounced, by
Judges. This is the distinction taken those which
are pronounced grounded in the merits, and those which are not
grounded upon the merits: all those which are not
grounded on the merits, are not only in themselves
wrong but by those by whom they are pronounced known
to be so: yes and not only known, but by this very
denomination thus given to them acknowledged and declared
to be so.
