§. Costs.
For effecting this profitable and maximization, the
amongst the great variety of arrangements employed by the
authors of the system of judicature those employed the
following be are in a more particular degree efficient.
1. One is The radical one – the rendering the theatre of judicature is at
any rate the faculty of intercourse with the Judge inaccessible
down to that period at which all the evil bt which
by such intercourse might have been prevented, has taken
place. Say, Exclusion of the parties from the presence of the Judge.
2. Another is the giving impunity to false assertion those false assertions
in the case where the truth of the assertion is necessary
to give a just foundation to the claim demand or the refusal,
the Judge being fully conscious of he falsity of it, but
at the same time acting upon it in a manner in
which he could not be morally justified in acting upon it but
as to supposition of his understanding it to be true.
