Ch. Costs.
A more simple or more demonstrative
proof can not be given of any proposition than
has been given in all Monarchical governments
by the course taken in regard to costs.
A tax imposed upon any article is a prohibition
of the use of it to all who have not wherewithal
to pay it. In England, the vast majority of
the people are in this case having what is
barely sufficient to maintain them in their own
indigence, they have not any thing to spare for
this tax: for that part of the produce of it which
is applied by government to the general exigencies
of the state, with the addition of that other part,
which the Judges have been suffered by their own
hands and those of their Instruments to add in
the shape of fees to their enormous salaries, with
the addition of the further enormous retribution
secured to the mercenary & essentially treacherous
allies of the people in the war of litigation.
In Bonaparte's Codes, the least had that as
yet are to be found anywhere, this same proposition
stands demonstrated by a proof not less
simple or conclusive: the first time any mention
is made of the Dependant, the assumption is
made that he is provided with a mercenary lawyer, with
an Anoné is the word: no anoné, no defence.
On the pursuer's side, no such explicit intimation
is conveyed, but for the commencement of the suit a form of citation is required
to be pursued, and to comply with this
requisition, is manifestly and undeniably put
out of the power of every man who is not initiated
in the secrets of the law.
